PROGRAM DESCRIPTION: The May 2019 Sweepstakes (the “Sweepstakes”) enables up to 10 Oregon families to win $250 for an Oregon College Savings Plan account.

ELIGIBILITY: Eligibility is limited to legal Oregon residents who are at least 18 years of age with a valid Social Security Number or Taxpayer Identification Number (“Entrant”). Employees, directors, officers, trustees and agents (and their respective household and immediate family members, such as spouses and siblings, parents and children and their spouses) of The Bank of New York Mellon Corporation, Sumday Administration, LLC, and their affiliates, the Oregon State Treasury, the Oregon 529 Savings Board, the Oregon 529 Savings Network and any of their affiliates and any promotional or marketing partners associated with the Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible.

HOW TO ENTER: Eligible entrants must provide all required information on the online form located at during the month of May 2019. Incomplete entry forms are void. There is a limit of one (1) entry per person. Submissions generated by a script, macro or other automated means will be disqualified. Submissions not complying with these Official Rules or incomplete entries are subject to disqualification. Entries MUST BE SUBMITTED ONLINE no later than 5:00 PM Pacific Time on May 31, 2019.

PRIZES: Up to ten (10) prizes of $250, each in the form of an Oregon College Savings Plan account, will be awarded. If a winner already has an active Oregon College Savings Plan account, the $250 will be deposited into the winner’s account. Otherwise, the winner will be required to open an account in accordance with the terms and conditions of the Oregon College Savings Plan. At the discretion of the winner, an award may be divided and deposited into more than one account.

SELECTION/VERIFICATION: The 10 winners will be selected in a random drawing conducted by the Administrator on or about June 1, 2019. Each winner will be notified by phone, email or US mail and must confirm his/her eligibility. Any selected winner who does not meet the eligibility requirements will be disqualified. A winner must complete, sign and return a Prize Claim Form by June 30, 2019 or his/her prize will be forfeited. The odds of winning a prize in the Sweepstakes depend on the number of eligible entries received.

CONDITIONS OF ACCEPTANCE OF PRIZE: Each winner, by accepting his/her prize, agrees that he/she is responsible for (a) all federal, state and local taxes, including income taxes, if any, applicable to acceptance and use of the prize and (b) any and all costs associated with the acceptance and use of a prize, and further agrees to provide his/her Social Security Number or Federal Taxpayer Identification Number for tax reporting purposes, if requested. No transfer or substitution of the prize is permitted, except at the sole discretion of the Administrator.

AGREEMENT TO THE OFFICIAL RULES: By entering the Sweepstakes, each Entrant fully and unconditionally agrees to accept these Official Rules and the decisions of the Administrator, which are final and binding in all matters related to the Sweepstakes.

CONDITIONS/RELEASE: By participating in the Sweepstakes, Entrants: (a) release the Sweepstakes Entities from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation in the Sweepstakes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of a contribution; (b) agree to indemnify and hold each of the Sweepstakes Entities harmless from and against any and all liability for any claims, costs, injuries, losses or damages of any kind to third parties caused by Entrant’s participation in the Sweepstakes; and (c) acknowledge that the Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to college funding. Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of Entrant information or mistakes, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in this Sweepstakes. By accepting a prize, a winner grants to the Sponsor the right, except where prohibited by law, to use his/her name, likeness, picture, address (city and state), e-mail address, voice, biographical information, written or oral statements, for advertising and promotional purposes in promoting the Oregon College Savings Plan, Sponsor, the Administrator or their websites, or this Sweepstakes or succeeding promotions, without compensation unless required by law. A winner shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of his or her name, picture, likeness, address (city and state), e-mail address, biographical information or Official Entry Form. The rights granted under this paragraph shall extend to the Sponsor, the Administrator and their affiliated agencies or marketing partners with respect to all winners of the Sweepstakes.

CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO TAMPER WITH OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of being executed as planned, or unauthorized intervention, fraud, action of any Entrant, technical failure or any other cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any suspect entry or Entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination, modification or suspension, notice of such action will be posted at, and the Sponsor may, in its sole discretion, identify funding recipients from among all eligible, non-suspect submissions received as of the date of the termination, cancellation, modification or suspension.

DISPUTES: Entrants agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Entrant or any prize awarded shall be resolve individually, without resort to any form of class action. Venue and jurisdiction for any such claims or causes of action lie exclusively with the Circuit Court of Oregon for Marion County and Entrant hereby consents to the personal jurisdiction of such court; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will an Entrant be permitted to obtain an award for, and Entrant hereby waives all rights to claim, punitive, incidental, indirect and consequential damages and any other damages other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor or Administrator in connection with the Sweepstakes shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflicts of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.
